We design and sell hardware products and related accessories for in vehicle use.

We may also provide software features and updates that work with our products.

We aim to keep this information accurate and up to date, but minor variations in color, appearance or packaging may occur.

Your order is an offer to purchase the products you select under these Terms.

We may accept or reject an order at our discretion.

We will normally confirm acceptance by sending you an order confirmation email.

The contract between you and us is formed when we send this confirmation.

  • prices are shown in United States dollars (USD)

  • for customers in the United Arab Emirates, any applicable value added tax (VAT) and fees will be shown at checkout

  • for customers outside the United Arab Emirates, local taxes, duties or import charges may be charged separately by your local authorities.

All payments are processed in USD unless clearly stated otherwise at checkout.

If your card is issued in another currency, your bank or payment provider may convert the amount to your local currency at its own exchange rate and may apply additional fees.

You represent and warrant that:

Available shipping options, estimated delivery times and shipping costs will be shown at checkout.

Estimated delivery times are provided for convenience and are not guaranteed.

Actual delivery may be affected by factors beyond our control such as customs clearance, courier delays or local holidays.

Risk of loss or damage to products passes to you when the products are delivered to the address you provide.

Please inspect the package on delivery and notify us promptly if there is visible damage.

  1. Returns, refunds and cancellation

Your rights in relation to returns and refunds are described in our Shipping and Returns Policy, which forms part of these Terms.

In summary and subject to the full policy:

  • if a product is defective, damaged in transit or does not match the description on our website, you should contact us within the time frame stated in the policy so that we can repair, replace or refund the product, and

  • if we offer change of mind returns, these are subject to conditions such as the product being unused and in resellable condition and you covering the cost of return shipping.

Nothing in these Terms or in our Shipping and Returns Policy limits any mandatory consumer rights you may have under applicable laws.

 

  1. Warranty and after sales support

We may provide a limited warranty on our products, as described on the product page or in the product documentation.

The warranty, if provided, will cover defects in materials or workmanship under normal use for a specified period.

It does not cover damage caused by misuse, accidents, unauthorized modifications, improper installation or normal wear and tear.

  • remove, alter or obscure any copyright, trademark or other notices on the Service.

If the Service allows you to submit reviews or other content, you are responsible for that content.

You must not submit content that is unlawful, offensive or infringes the rights of others.

These Terms and any dispute or claim arising out of or in connection with them or with the Service will be governed by and construed in accordance with the laws of the United Arab Emirates.

Subject to any mandatory provisions of applicable consumer law, the courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

Nothing in this section limits any mandatory rights you may have to bring proceedings in another jurisdiction under applicable consumer protection laws.

These Terms of Service (the "Terms") govern your access to and use of the Screenmate Dash mobile and in vehicle application and any related software, services and features (together, the "App") provided by Screenmate L.L.C-FZ ("Screenmate", "we", "us" or "our").

By downloading, installing or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the App.

These Terms should be read together with our Privacy Policy, which explains how we collect and use your personal data when you use the App.

  • reverse engineer, decompile or attempt to extract the source code of the App except where this is permitted by applicable law,

  • distribute, sell, rent, lease, sublicense or otherwise transfer the App to any third party,

  • remove, alter or obscure any copyright, trademark or other proprietary notices in the App.

We reserve all rights in and to the App that are not expressly granted to you under these Terms.

 

  1. App updates and changes

We may from time to time provide updates, bug fixes, improvements or new features for the App.

These may be installed automatically or may require you to install them manually.

Certain features of the App may not function properly if you do not install updates.

We are not responsible if you experience issues because you have not installed the latest version of the App.

We may modify, suspend or discontinue any part of the App at any time, including specific features or content, in order to improve the service, maintain security or comply with legal requirements.

 

  1. Connection with hardware and vehicle use

The App is designed to work together with Screenmate hardware products installed in your vehicle.

You are responsible for:

  • installing and using the hardware in accordance with our instructions and any applicable vehicle manufacturer requirements,

  • using the App and hardware in a safe manner and in compliance with traffic laws and regulations in your country.

You must not interact with the App in a way that could distract you from driving or reduce your ability to operate your vehicle safely.

Where possible, configure and adjust settings only when your vehicle is parked.

We are not responsible for any fines, penalties, accidents or damage arising from unsafe or unlawful use of the App or hardware.

 

  1. Acceptable use

You may use the App only for lawful purposes and in accordance with these Terms. You must not:

  • use the App in any way that violates any applicable law or regulation,

  • use the App to transmit any content that is illegal, harmful, offensive or infringes the rights of others,

  • attempt to gain unauthorized access to the App or any related systems or networks,

  • introduce viruses, malware or other harmful code into the App,

  • interfere with or disrupt the operation of the App or the experience of other users,

  • use any automated means to access, monitor or interact with the App without our prior written permission.

We may monitor the technical performance and security of the App to ensure proper functioning and compliance with these Terms.

 

  1. In app services, subscriptions and fees

Some features of the App may be offered free of charge, while others may require a one time purchase, subscription or activation together with Screenmate hardware.

Where fees apply, we will clearly inform you of:

  • the price and currency,

  • whether the payment is one time or recurring,

  • any additional taxes or charges that may apply,

  • the main conditions of the subscription (billing period, renewal, cancellation).

If you purchase a subscription through an app store (such as Apple App Store or Google Play), your payment relationship is with the app store and their terms will apply to billing, renewal and cancellation.

You must follow the app store's instructions to manage or cancel your subscription.

We may change pricing and subscription plans from time to time, in accordance with applicable law.

Changes will not affect billing periods that have already been paid for.

 

  1. Data and privacy

When you use the App, we may collect and process personal data such as:

  • account information,

  • device and usage data,

  • technical logs,

  • certain driving related or in vehicle interaction data where applicable.

We collect and use this data in accordance with our Privacy Policy and with applicable data protection laws, including Federal Decree Law No. 45 of 2021 on the Protection of Personal Data (PDPL) in the United Arab Emirates.

Our Privacy Policy explains:

  • what data we collect,

  • how we use and share it,

  • the legal bases for processing,

  • your rights in relation to your personal data and how to exercise them.

By using the App, you acknowledge that you have read our Privacy Policy.

 

  1. Third party services and platforms

The App may use or interact with third party services, including:

  • mobile operating systems (iOS, Android),

  • app stores (Apple App Store, Google Play),

  • analytics, crash reporting and cloud services,

  • navigation or mapping services.

Your use of such third party services may be subject to the terms and privacy policies of those third parties.

We are not responsible for the content, terms or privacy practices of any third party services.

If you download the App from an app store, you acknowledge that:

  • the app store is not responsible for providing maintenance or support for the App,

  • the app store is not responsible for any warranty obligations beyond what is required by applicable law,

  • the app store is not responsible for handling claims related to the App or your use of the App.

 

  1. Intellectual property

All intellectual property rights in and to the App, including its design, code, graphics, trademarks and branding, are owned by Screenmate or our licensors.

You are granted only a limited license to use the App as described in these Terms.

Nothing in these Terms transfers any ownership rights to you.

You must not use Screenmate names, logos or other trademarks without our prior written consent.

 

  1. Disclaimer of warranties

The App is provided on an "as is" and "as available" basis, to the fullest extent permitted by law.

We do not guarantee that:

  • the App will be uninterrupted, error free or free of harmful components,

  • the App will be compatible with all devices or vehicle systems,

  • the information provided by the App will always be accurate, complete or up to date.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non infringement.

Nothing in these Terms affects any warranties or rights that cannot be excluded or limited under applicable law.

 

  1. Limitation of liability

To the maximum extent permitted by law, we will not be liable for:

  • any indirect, incidental, special or consequential loss or damage,

  • any loss of profits, revenue, business, goodwill or data,

  • any loss or damage arising from your unsafe or unlawful use of the App or Screenmate hardware,

  • any loss or damage caused by events beyond our reasonable control.

Our total liability for any claims arising out of or in connection with the App or these Terms will be limited to the amount you have paid, if any, for access to the App during the twelve (12) months before the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

 

  1. Consumer rights

Nothing in these Terms is intended to exclude or limit any mandatory rights you may have as a consumer under the laws of the United Arab Emirates or other applicable laws in your country of residence.

If there is any conflict between these Terms and mandatory consumer protection rules, those rules will prevail.

 

  1. Suspension and termination

We may suspend or terminate your access to the App, in whole or in part, if:

  • you materially breach these Terms,

  • your use of the App poses a security risk or could harm other users or our systems,

  • we are required to do so by law or by a competent authority,

  • we decide to discontinue the App.

Where reasonable, we will notify you in advance of any suspension or termination and explain the reasons, except where we are legally prevented from doing so.

You may stop using the App at any time by uninstalling it from your devices.

If you wish to delete your account, you can contact us at info@screenmate.co.

Sections of these Terms that by their nature are intended to survive termination will continue to apply, including those on intellectual property, limitation of liability, governing law and dispute resolution.
